Membership & Outreach Committee: Jacqueline M. Zalewski

Our next Membership and Outreach Committee spotlight comes from Dr. Jacqueline M. Zalewski, West Chester University of Pennsylvania, who shares that the Department of Labor released a final rule on January 9, 2024 that changes the criteria for classifying independent contractors. This rule goes into effect on March 11, 2024 and rescinds the rule passed in January 2021. The past rule was based on two core factors for determining whether a worker is an employee or independent contractor (control over the work and opportunity for profit or loss), while the new rule includes six factors. In addition to the two factors in the past rule, the new rule includes: the amount of skill and initiative required for the work; the degree of permanence of the working relationship; the worker’s investment in equipment or materials required for the task; and the extent to which the service rendered is an integral part of the employer’s business.
